Driven Young Bali Retreat Terms and Conditions

By enrolling in the Driven Young Bali Retreat (hereinafter referred to as "Retreat"), you (hereinafter referred to as "Participant") agree to be bound by the following Terms and Conditions. These terms govern your participation in the Retreat, your rights, and our responsibilities, ensuring the safety, legality, and enjoyment of all involved. Driven Young (hereinafter referred to as "Company") reserves the right to amend these terms at any time.

1. Retreat Overview

The Retreat will take place in Bali, Indonesia, over a period of 7 days, comprising 5 full days and 2 half days. The dates, location, schedule, and all other pertinent details will be provided to Participants in advance.

2. Travel and Accommodation

2.1 Participant Responsibility for Travel: Participants are solely responsible for arranging and covering the costs of their travel to and from the retreat venue in Bali. This includes but is not limited to flights, ground transportation, visas, and travel insurance.

2.2 Accommodation and Services Provided: The Company will provide accommodation for the duration of the Retreat, including meals and activities outlined in the retreat program. Any services or activities not explicitly included in the retreat program are the sole responsibility of the Participant.

3. Payments, Deposits, and Refunds

3.1 Payment Options: Participants may choose to pay for the Retreat in one of the following ways:

  • Full Payment: The total amount must be paid upfront at the time of booking.
  • Payment Plan: Participants may opt for a payment plan, with an initial deposit due at the time of booking, followed by scheduled payments. All payments must be paid up to date in order to attend the retreat.

3.2 Refund Policy: Participants have the right to a full refund if they cancel their attendance within 7 days of their initial booking (the "Refund Window"). All refund requests must be submitted in writing within this timeframe.

3.3 Cancellation by Participant:

  • Participants may cancel their attendance without penalty up to 60 days (2 months) before the start of the Retreat, provided they present a verifiable reason for their inability to attend, which is acceptable to the Company (e.g., medical emergencies, personal circumstances).
  • Any cancellations made within 60 days of the Retreat’s start date will not be eligible for a refund, regardless of the reason.

3.4 Cancellation by Company: In the unlikely event that the Company cancels the Retreat due to unforeseen circumstances (e.g., natural disasters, pandemics, political instability), Participants will receive a full refund of all monies paid. The Company is not responsible for any travel expenses or other costs incurred by Participants.

4. Participant Conduct and Behavior

4.1 Code of Conduct: Participants are expected to act respectfully and professionally towards fellow Participants, staff, and third-party providers throughout the Retreat. Discriminatory, disruptive, or illegal behavior will not be tolerated and may result in removal from the Retreat at the Company’s sole discretion.

4.2 Right of Removal: The Company reserves the right to remove any Participant from the Retreat at any time due to poor behaviour, including but not limited to violations of the Driven Young Community Code of Conduct, failure to comply with local laws, or actions that negatively affect the safety, well-being, or enjoyment of other Participants. In such cases, the following refund policy applies:

  • Before the 60-day non-cancellation window: If the Participant is removed more than 60 days before the Retreat, they will be entitled to a full refund of any payments made, minus any non-refundable deposit or costs incurred by the Company.
  • Within the 60-day window: If the Participant is removed within 60 days of the Retreat, they are not automatically entitled to a refund. However, the Company will review such cases individually and may, at its sole discretion, issue a partial or full refund depending on the specific circumstances surrounding the removal.

4.3 Compliance with Local Laws: Participants must comply with all local laws and regulations of Bali and Indonesia during the Retreat. The Company assumes no responsibility for any legal issues or penalties arising from the Participant’s failure to comply with such laws.

5. Intellectual Property and Confidentiality

5.1 Ownership of Retreat Content: All materials, teachings, methods, and resources provided during the Retreat are proprietary to the Company and its facilitators. By attending the Retreat, Participants agree that they will not use, reproduce, distribute, or claim ownership of any intellectual property, including but not limited to program content, teachings, and methodologies, for personal or commercial purposes without the express written permission of the Company.

5.2 Non-Disclosure Agreement: Participants are prohibited from sharing or disseminating any confidential information disclosed during the Retreat, including but not limited to business strategies, methodologies, or any other proprietary knowledge, without prior written consent from the Company.

6. Assumption of Risk, Liability Waiver, and Insurance

6.1 Assumption of Risk: Participants acknowledge that by participating in the Retreat, they may be exposed to risks, including but not limited to injury, illness, accidents, and other hazards. Participation in physical activities, excursions, and other events organized by the Company is entirely voluntary, and Participants assume all risks associated with such activities.

6.2 Health and Medical Needs: Participants are responsible for ensuring they are in good health and capable of participating in the activities provided during the Retreat. Any known medical conditions, allergies, or special dietary needs must be communicated to the Company prior to the Retreat. The Company does not assume any responsibility for the Participant’s medical care or the availability of medical services during the Retreat.

6.3 Liability Waiver: The Company, its directors, officers, employees, agents, and contractors shall not be held liable for any injury, illness, death, loss, or damage to personal property that may occur during the Retreat, whether caused by negligence or otherwise. Participants agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from their participation in the Retreat.

6.4 Travel Insurance Requirement: Participants are strongly advised to obtain comprehensive travel insurance that covers personal injury, medical expenses, emergency evacuation, trip cancellation, and personal liability before attending the Retreat. The Company is not responsible for any costs incurred due to the Participant’s failure to secure adequate insurance.

7. Force Majeure

The Company shall not be liable for any failure or delay in performing its obligations under these Terms and Conditions due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, pandemics, or governmental restrictions.

8. Indemnification

Participants agree to indemnify, defend, and hold harmless the Company, its affiliates, directors, officers, employees, agents, and contractors from any and all claims, liabilities, damages, or costs (including reasonable attorney fees) arising out of or related to their participation in the Retreat, including but not limited to any breach of these Terms and Conditions.

9. Dispute Resolution

Any dispute arising out of or relating to these Terms and Conditions, including any breach or alleged breach thereof, shall be resolved through good faith negotiation between the parties. If the dispute cannot be resolved amicably, it shall be submitted to mediation in Sydney, New South Wales, Australia. If mediation fails, the dispute shall be submitted to binding arbitration in accordance with the rules of the Australian Centre for International Commercial Arbitration (ACICA). Each party shall bear its own costs and attorney fees, regardless of the outcome.

10. Severability

If any provision of these Terms and Conditions is held to be invalid or unenforceable by any court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

11. Governing Law

These Terms and Conditions are governed by and shall be construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles. Participants agree to submit to the jurisdiction of the courts located in Sydney, New South Wales, Australia for the resolution of any disputes arising out of or related to these Terms and Conditions.

12. Entire Agreement

These Terms and Conditions constitute the entire agreement between the Participant and the Company regarding the Retreat and supersede all prior or contemporaneous communications, whether electronic, oral, or written.

By registering for the Driven Young Bali Retreat, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
